What are chances Texas will legalize medical marijuana in 2019?

New Texas hemp and CBD law could snuff out marijuana prosecutions

The state of marijuana regulation in Texas, as it stands at the beginning of , is a puzzle. For those of the right race and socioeconomic status, weed is effectively legal.

In the state's big cities especially, pot isn't seen as a scourge — police departments are citing and releasing those caught for possession, and many district attorneys aren't prosecuting low-level marijuana cases at all — but as something the state is behind on.

Officially, however, marijuana is still very, very illegal in the state. As states around the country have moved to legalize recreational pot use for adults, Texas legislators, especially in the Texas Senate, have dug in their heels.

It went nowhere in the Texas Senate, thanks in large part to Lt. Dan Patrick, a staunch opponent of anything that even hints at Texans being able to make their own decisions about recreational marijuana use.

What the vast majority of Texans who support pot legalization got instead were two concessions, one small and intentional and one huge and inadvertent.

A bigger change was the state's decision to legalize industrial hemp. Texas' new law says that any cannabis with THC content of lower than 0.

Unfortunately for many law enforcement agencies in the state, Texas didn't have labs capable of accurately and quickly measuring the amount of THC in the cannabis with which people were being busted, so some prosecutors began refusing to prosecute anyone for pot possession.

As Texas moves into , it's important for those who support progressive drug policy to pay attention to the regulatory apparatus that gets installed to monitor both the compassionate use program and industrial hemp, says Jax Finkel, the executive director of Texas NORML.

A plant with a certain percentage of a certain chemical is legal, but if you have more than that it's illicit. There hasn't been a wave of ill effects, despite Texas' urban counties taking their collective feet off the gas when it comes to enforcement, Finkel says.

Despite the improvement of conditions on the ground, Finkel says, it's still important that the Legislature gets in line with public opinion.

While Texas' laws have evolved at a glacial pace, people and elected officials across the state are having conversations that they never would have had a decade ago.

That's a good thing, according to Finkel. Even though things are moving, there are other conversations that have not been had. Keep the Dallas Observer Free Since we started the Dallas Observer , it has been defined as the free, independent voice of Dallas, and we would like to keep it that way.

The enactment of HB also caused an outcome that legislators did not intend. Because it changed the legal definition of marijuana from cannabis in general to cannabis containing greater than 0.

In June , Gov. Abbott signed House Bill which increased the number of qualifying conditions eligible for treatment under the state's low-THC medical cannabis program.

Under the program, persons possessing less than two ounces of cannabis would still be subject to arrest, but could avoid a criminal conviction by attending drug education classes or performing community service.

Under the new program, persons possessing less than four ounces of cannabis would not face criminal charges or even be issued a citation as long as they agreed to attend a four-hour drug education class.

In April the Dallas City Council voted 10—5 to adopt a cite-and-release policy for possession of less than 4 ounces of cannabis. In September , Bexar Country District Attorney Nico LaHood announced a new cite-and-release policy for persons caught with less than 4 ounces of cannabis.

Named the First Chance Program, it only applies to people that are not caught with any other drugs. In April , Dallas County District Attorney John Creuzot announced that individuals caught possessing misdemeanor amounts of cannabis would no longer be prosecuted for first-time offenses.

Individuals who commit subsequent offenses would be offered diversionary courses to avoid a criminal conviction. In May , Bexar County District Attorney Joe Gonzales announced that an expanded version of cite-and-release would be implemented during the summer and apply to San Antonio Police Department as well.

In January , Austin City Council voted 9—0 in favor of a resolution that effectively eliminates penalties for possessing up to 4 ounces of cannabis and directs the city manager to "take the steps necessary and appropriate to eliminate, to the furthest extent allowable under state law In May , El Paso City Council voted 7—0 to adopt a cite-and-release policy for possession of less than 4 ounces of cannabis.
